# Skyhills Casino: is it legal in the Netherlands, and what does the €37 million fine mean?

> No, Skyhills isn't legal in the Netherlands: it has no licence from the Kansspelautoriteit (Ksa). On October 22, 2026 the Ksa published a €37,250,000 fine on EOD Code SRL, the company it says runs Skyhills, Instantcasino and ten other sites, for offering gambling to Dutch players without a licence: its highest fine yet for illegal gambling, though it can still be challenged. Since around September 2026, skyhills.com no longer offers games: it says Skyhills is no longer available and points visitors to other casinos.

## Key takeaways

- Skyhills isn't on the Ksa's list of licence holders, and the Ksa found it never granted a licence for this offer.
- The Ksa fined EOD Code SRL €37,250,000 for offering gambling in the Netherlands without a licence on skyhills.com, instantcasino.com and ten other sites (decision of October 6, 2026, published October 22); EOD Code can still object, but an objection doesn't suspend the fine.
- EOD Code had already broken a 2025 order to stop, forfeiting the maximum €840,000 in penalty payments.
- Since around September 2026, skyhills.com shows a notice that Skyhills is no longer available and links to other casinos instead.
- Playing at an unlicensed site knowingly is prohibited, Cruks doesn't apply there, winnings must be declared to the tax authority, and since July 2026 losses can't be reclaimed on the grounds that the contract was void.

## The short answer

Skyhills isn't legal in the Netherlands. It isn't on the Kansspelautoriteit's list of licence holders, and the Ksa found that it never granted a licence for it. On October 22, 2026, the Ksa published a **€37,250,000 fine** on EOD Code SRL, the company it says runs Skyhills, Instantcasino and ten other sites, for offering gambling to Dutch players without a licence. It's the Ksa's highest fine yet for illegal gambling, though EOD Code can still object. Since around September 2026, skyhills.com no longer offers games.

## What Skyhills was

Skyhills was an online casino and sportsbook at skyhills.com, with slots, sports betting and live casino games, according to the Ksa's decisions. The Ksa found that people in the Netherlands could open an account, deposit and play on skyhills.com on November 24, 2025, with no technical measures to keep them out. On Skyhills and the company's other sites:

- "The Netherlands" was filled in automatically when you signed up, and the Dutch country code +31 was offered for your phone number;
- the payment process was wholly or partly in Dutch, and skyhills.com offered payment through Rabobank;
- players could deposit in several cryptocurrencies, with their balance shown in euros.

Dutch influencers promoted skyhills.com through their Instagram, YouTube and Discord channels, and TikTok videos used its logo with Dutch text, the Ksa found. In June and September 2025 it ordered four influencers whose posts promoted Skyhills to stop, under penalty payments of €25,000 per breach up to €75,000.

## Is Skyhills legal in the Netherlands?

No. In the Netherlands only companies licensed by the Kansspelautoriteit may offer online gambling, and only on the websites the Ksa lists for them in its [Kansspelwijzer](https://kansspelautoriteit.nl/kansspelwijzer). Neither Skyhills nor EOD Code, nor any of its other sites, is on that list, and the Ksa states in its decisions that it granted no licence for this offer. A licence from another country, whatever it is, wouldn't change that.

## The €37.25 million fine

The Ksa's fine decision is dated October 6, 2026, was sent on October 7 and published on October 22. It finds that EOD Code broke article 1(1)(a) of the Wet op de kansspelen, which prohibits offering games of chance without a licence, on twelve sites:

instantcasino.com (also at instantcasino17.com), skyhills.com, slotmonster.com, betiro.com, betblast.com, fastslots.com, goldenpanda.com, sambaslots.com, winningz.com, incognitocasino.com, foxygold.com and luckypays.io.

**How the Ksa calculated it.** EOD Code didn't answer the Ksa's request for figures, so the Ksa estimated its Dutch gross gaming result from search volumes: €108,374,000 across the twelve sites in 2025. Because of aggravating circumstances it set the fine at 270% of that, €292,600,000. The law caps a fine at 10% of a company's worldwide turnover, which the Ksa estimated at €372,989,000, so it reduced the fine to €37,250,000.

**What made it worse.** The Ksa added percentage points for:

- no visible age check before an account was opened;
- prohibited bets;
- autoplay and turbo play;
- no play limits, or limits that were filled in in advance;
- minimum deposits and deposits in cryptocurrency, which the Ksa says can facilitate tax evasion and money laundering;
- an inactivity fee of €5 a month and unfair terms, such as a clause letting the operator keep a player's balance after permanent self-exclusion. These terms come from Instantcasino's conditions; we couldn't recover Skyhills' own terms from that period.

**Is it final?** No. EOD Code can object within six weeks of the decision being sent, but an objection doesn't suspend it. EOD Code didn't respond when the Ksa invited its view. The previous record fine for illegal gambling was €24,846,000, for Novatech Solutions, published on March 10, 2026.

## The 2025 order and €840,000 in penalty payments

Before the fine, the Ksa had ordered EOD Code to stop. Its order of July 29, 2025, published on August 26, 2025, was about instantcasino.com but covered all the company's websites: stop within four weeks, or forfeit €280,000 a week, up to €840,000. Checks on September 5, 12 and 19, 2025 showed the offer was still running, so the full €840,000 was forfeited, and on December 11, 2025 the Ksa decided to collect it. Both decisions are final. In December 2025 EOD Code hadn't paid; whether it has since isn't public.

## Who is behind Skyhills?

According to the Ksa:

- **EOD Code SRL** is registered in San José, Costa Rica, according to Costa Rica's chamber of commerce register.
- Instantcasino's terms named **Atlantis Interactive SRL** as the owner of the site; according to information the Ksa obtained from Creditsafe, Atlantis Interactive now operates as EOD Code SRL.
- Instantcasino said it was registered and regulated in Costa Rica, with Costa Rican law applying and the courts of Curaçao alone competent for claims against it.

**The Anjouan seal.** Archived copies of Skyhills' pages from January 2025 and June 2026 loaded a licence seal of the Offshore Finance Authority of the State of Anjouan. The seal's own validation page now gives Skyhills' operating status as "INVALID" and says it is "NOT Licensed" by the Anjouan authority. The same page lists the Netherlands among the "Excluded Territories" and says complaints from players there "will not be entertained". Anjouan's public register of current licences has no entry for EOD Code, Atlantis Interactive or any of the twelve sites; it doesn't show past licences, so it can't tell us whether Skyhills ever held one.

**Belgium.** The Belgian gambling regulator, the Kansspelcommissie, put skyhills.com on its list of blocked illegal gambling sites on November 20, 2025 (published December 1, 2025), together with several of EOD Code's other sites.

## What skyhills.com shows now

Sometime between August 19 and September 13, 2026, according to the Internet Archive, skyhills.com stopped working as a casino; the new site's own pages are dated September 11, 2026. Visitors now see a notice that "SkyHills Casino is no longer available, please check out the recommended casinos below", followed by links to other casino brands, which the site's own code labels as affiliate links. Its Dutch pages include guides to casinos "without a Dutch Ksa licence and without mandatory Cruks checks". The site's current terms name no operator, licence or address, yet say it accepts players from the Netherlands. We don't link to skyhills.com or to the casinos it recommends.

What we couldn't find out: the exact date Skyhills stopped taking bets, whether players got their balances back, and whether the brand continues under another address.

## What it means if you played at Skyhills

- **Cruks didn't protect you.** Cruks, the Dutch exclusion register, only works at licensed Dutch sites; Skyhills' own Dutch pages say foreign platforms aren't covered.
- **Playing was prohibited.** Article 1(1)(c) of the Wet op de kansspelen prohibits using an unlicensed game if you know it has no licence, and the Ksa says that rule is aimed explicitly at players.
- **Winnings must be declared.** The Belastingdienst says that if you won more than you staked in a calendar month at an online site without a Dutch licence, you must file a gambling-tax return for that month; the rate is 37.8% in 2026.
- **Getting money back is hard.** OpenOverGokken, the Ksa's information and help service, warns that illegal sites sometimes don't pay out, and advises contacting the company first, then Het Juridisch Loket, and reporting the problem to the Ksa. On July 3, 2026, the Hoge Raad, the Dutch Supreme Court, ruled that contracts with unlicensed online operators aren't void (ECLI:NL:HR:2026:1159), so a refund claim on that ground fails; claims based on tort or error remain possible in some circumstances.
